I have a question regarding Future Employment salary start date because my current salary is a little bit lower then the salary in PERM
and I-140.
I have approved PERM and I-140 with priority date in December 2005.
I'm going to apply 485 and probably EAD in July.
The future job salary in my approved PERM and I-140 is $30/hour
At present time I earn $29/hour.
When does my employer should start to pay $30/hour?
1) Before I submitted 485
2) After I submitted 485
3) After I submitted EAD
4) After I got EAD approval
5) After I got 485 approval
and I-140.

How long it take (in terms day) to receive actual RFE mail notice after LUD status update online about RFE?
No RFE so far. Like I said all I see is new LUDs and all the online messages on i-485 cases say "case received and pending" on all cases. All cases are at Nebraska.

It is called interfiling. You can use a new 140 (approved or pending) to replace the existing 140 (approved or pending) for an I-485. Even though the common perception is that the PD must be current, it is not true (per Murthy).
I'm not a legal person, please verify from an attorney

I am an Indian citizen. I have an approved I-140 under National Interest Waiver with a PD of Aug 31, 2007. I am now a permanently employed scientist at a National Lab. I think I am now eligible for application under EB-1 Outstanding researcher category. Is it possible to apply for I-485 without another I-140? It will take quite some time to secure all the recommendation letters to apply for EB-1 (OR). I am wondering if I can bypass the whole process of I-140 and directly apply for adjustment of status based on my approved I-140 saving time and effort.

You need to start from ground zero...EB2 NIW is different from EB1, so you can not use the EB2-140

Hi,
I am on H1B visa staying in Missouri state and my employer location is the same county. I recently got a project outside Missouri and client worksite is in Arizona. I am expected to travel Monday to Thursday from Missouri to client worksite but not required to move to Arizona. In this case where I am travelling does my employer need to file for LCA amendment? I have come across posts that if you move to a new worksite you might need LCA amendment but not sure in this case where I am travelling every week.
Your quick response would be greatly appreciated.

The court concluded that the Memorandum does not constitute final agency action subject to judicial review and the notice and comment requirements under the APA. You should be fine. When entering just answer the IO aptly. One common question is
1. Purpose of your visit?
2. Whom you are working for? <Be honest, tell them your current employer if asked>
If you are traveling on AP with family the above questions will be asked only to the primary person, they don't question others who are traveling with you.

During this tough times of un-employment, it is very unfortunate that many of us lose our jobs. As a result many of us lose medical benefits too. If I-140 is approved and priority date is current is it possible to keep on extending H1B for couple of years without applying for I-485? I am asking this quetion because my employer is not allowing me to apply for I-485 as my I-140 is pending. It looks like he want to use me for couple of years on H1b.

I got my GC but my wife's application (based on my 485) is still pending. I think at this point I can switch jobs/go to school full time and it won't affect my spouse's case. Just want to double check on this, any thoughts??

I'm facing a frustrating issue and am hoping that someone can provide help on this. I'm on my H1 10th year extn. My I-140 (EB-3) was recently approved and I cannot apply for I-485 as the visa dates are not available. My Company recently changed their name from ABC, doing business as XYZ, to DEF, doing business as XYZ (the doing business as part of the name is the same and there was no merger, just a name change).
My first question is does this invalidate my approved I-140 and should I refile the I-140. Also, when I file my H-1 extension what document should I provide to prove the name change (or is it even needed?)? Any help on these 2 questions would be greatly appreciated. Thanks.
