I mean stay on L1A (7 Year) with existing company. Apply green card through company B OR any other (For applying grren card, you don't need to be employee of that firm). Switch job as soon as you get I140 (premium process) approved from B company. If everything goes well, One year is enough to get I140 approval through premium process.

We have not done anything to my passport yet. We initially thought of getting my name changed but for now we have kept it in the "to do list".. Not sure when will be able to get to it...

This is wrong. If you go out of USA and come back after a gap of 1 year, then only u will get full 6 years. Other wise whatever your status is ( as L1, B1 etc ) that will count into H1 period
As far as I know B1 wont count against H1 time, though L1 will.
L2 and H4 used to count, but they were decoupled at the end of 2006, and time spent in those status dont count against your H1.

The short answer is yes. Once you have an approved I-140, you can ask to be accorded the PD on any subsequent I-140.

I am going to apply for my H1 renewal. I have my I-140 approved and I-485 application pending from Aug 2007. Additionally, being from India, my visa number is retrogressed.
I got my first 3 year H1 extention from 2006-2009. Now I am appllying for my next 3 years H1 extention. However, I am seeing USCIS asking for client letter and copy of contract. Additionally, one employee of my company got renewal for 3 months only, since his project was getting over in 3 months.
My company gets Purchase Orders for 1 year duration only from my client, but I have a intent to renewal for up to 3 years. I am about to enter into my 2nd year of contract.
I am working with my lawyer to present my case the best way to ensure that we get a renewal of 3 years. Here is what my lawyer recently stated

This arises when USCIS issues a request for evidence specifically asking for such items as contracts and work orders. I think it would be better idea to call them and find out their hours of operation. The address is usually given on the FP notice letter.

I think: We donot have a choice. We have to show up on the day and time given on FP notice. If we can't- we have to request uscis for re-scheduling.

To my knowledge they consider the salary you were getting in the last one year to calculate UI benefits. If you are applying one year after the job loss, chances that you get anything is very low.
Anybody who is eligible to work in US and has enough work credit can apply for unemployment insurance benefits. I think, USCIS will know about this but sending RFE to people about this is not feasible.

My 6 year H1 term expired in Jan 2010 (not applied for extension yet). I live in IL.
I took the motorcycle training class and passed. Now, I have to go to the DMV to get the license. My existing 4 wheeler license is valid upto 2011. Will I get my motorcyle license only till 2010 (end of H1)?

I entered US last december 2007 with a visitors visa,allowed me to stay for 6 mos.,last march 2008 I married my fiance who has a H1b visa and is working right now here in the US and last May 2008 I Applied for a change of status from visitors to H4 dependent..Until now the case is pending but right now we had a family crisis back home and I have to go back home asap...what will happen with my application if I go home...Will I still be able to come back here and will I be out of status if I leave my pending application here???

My husband recently changed jobs and has not updated the transfer in his H1 visa yet. I need to travel to India. Can i travel with the existing H4 with his new I-797 and salary stubs? Or do we have to updated the visas before we can travel?

I think this is due to bi-specilization program USCIS started lately. H1's are processed at CSC & VSC just like I-140's processed at TSC & NSC.
So your application would have gone to VSC when they share the applications for processing, though you belong to CSC.
I believe my resoning is correct!

Need some help/advice on PERM LC issue:
My employer has filed PERM LC (PD Sep 2008) in EB2 (Job Description: Masters OR Bachelors with 5 Yrs experience),
On may'09 got a query saying "Discrepency in Alien education and experience".
Stating: Alien workerer possessed Masters Degree and 16 months of experience where as the minimum job requirements set ETA form (H8 and H10)specified Masters and 5 yrs of experice.
my employer appealed saying: " H.4 in ETA does indicate masters deg. is the minimum requirement for the position and there is however no mention made of 5 yrs of exp. this appears in 8.A and 8.C as an alternate education and experience and therefore not related to the minimum requiremnt for the position"
Another mistake (which I don't know if its from PERM ior my employer) is even though i have more than 10 yrs of experience the reason for denial as you can see above says "Alien worker possessed Masters Degree and 16 months of experience where as the minimum job requirements set ETA form (H8 and H10)specified Masters and 5 yrs of experice."

I realize the miscommunication on my part so I apologize to my previous post that i didnt understand the reply.
I meant to ask if the primary applicant my spouse can take the extended leave on child care that is sanctioned by the employer .As a dependent I am aware that I can be without a job.

Both my wife and I also received a RFE on June 29th but don't know the content of the RFE because haven't received the CIS letter yet. I did submit the BC, however, so I hope that the RFE is not for BC. I don't know what else it could be.. I have been scratching my head since I got the email yesterday. Also called CIS but they wouldn't tell me what the RFE is about.

I have my birth certificate. My DOB is correct on it along with Date of its registration (DOB+5 days).
My father's name and mother's name is not spelt exactly the same as in my passport.
Example:
my father's name has an extra "bhai" in the name. xxxxbhai yyyyy zzzzz
my mother's name has only her first name and not her full name. aaaaa
My passport has thier correct full names.
What kind of document(s) would i need to submit in order for me to use thier names listed on the passport? Could this cause an issue?
OR am I preparing for no reason?
